Cross River: Tribunal sacks PDP legislator, orders rerun election

The election of the Peoples Democratic Party, PDP, legislator, Dr. David Etta representing Abi state constituency, in Cross River State, southern Nigeria, has been nullified and a rerun ordered within 90 days.

Panel Two of the State, National Assemblies and Governorship Election Petitions Tribunal headed by Justice A. A. Babawale declared the election of Dr. David Etta null and void while ruling in a petition by Iwara Inah, of the All Progressives Congress, APC.

The petitioner, who was the APC candidate in the election alleged that there were electoral malpractices, noncompliance with the 2010 electoral guidelines by the Independent National Electoral Commission, INEC, during the conduct of the March 9, 2019 election.

In the judgment, Justice Babawale said “votes in 15 polling units numbering 10, 400, which were cancelled could have been a deciding factor for either candidates”.

Babawale ordered a rerun to be conducted in the 15 PUs within 90 days and directed INEC to withdraw the Certificate of Return issued the PDP candidate.
