Judgment Forgery: AGF to dock Anambra South PDP candidate, others

Attorney General of the Federation, (AGF), Abubakar Malami, SAN will this Monday at the Federal High Court in Abuja, put on trial the senatorial candidate of the People’s Democratic Party, for Anambra South, Dr. Obinna Uzoh for allegedly forging court judgment and processes of an Abuja High Court to remove Senator Ifeanyi Ubah from office as the duly elected lawmaker in the senatorial district.

The PDP Senatorial candidate along with Anani Anacletus Chika, Eziafa Enwedo, Aroh Ifunaya and Faith Samuel are to be docked before Justice Okon Abang on a six-count charge bordering on conspiracy and forgery of court documents.

Mr. Uzoh was alleged to have conspired with Anani Anacletus Chika, Eziafa Enwedo, Aroh Ifunaya and Faith Samuel and forged originating summon in a suit No. CV/3044/2018 instituted against Senator Ubah contrary to Section 3(6) of the Miscellaneous Offences Act and punishable under Section 1 of the same Act.

They were also said to have conspired in September 2019 at the Federal Capital Territory, Abuja with intent to defraud, made a false judgment in suit No. CV/3044/2018 with intent to be acted upon to the prejudice of Senator Ubah contrary to Section 1 of the Miscellaneous Offences Act.

Among others, the defendants were at various times alleged to have forged filing receipts of a court case and also a seal of the Nigerian Bar Association, NBA to enable them institute a pre-election matter and to challenge the senatorial election of Senator Ubah of the Young Progressives Party, YPP.

Besides, the defendants were also alleged to have back-dated several court documents which they used to obtain judgment against the election of Senator Ubah.

Mr. Uzoh, who contested the senatorial election along with the incumbent Senator Ubah but lost at the poll conducted in 2019, had dragged Senator Ubah before a High Court of the FCT sitting in Bwari, alleging among others that Ubah forged a National Examination Council, NECO certificate which he used to secure clearance for his participation in the election.

On the strength of the alleged forged originating summon, filing receipts and back-date of court’s processes, the judge of the FCT High Court was said to have been misled into giving a judgment which annulled the election of Senator Ubah on the ground that he forged NECO certificate.

Senator Ubah who claimed that he was denied fair hearing in suit on the ground that he was never served with the originating summon and hearing notices before the judgment against him was delivered, had applied for a stay of execution of the judgment which the judge refused to grant.

Dissatisfied with the conduct of the case against him, the lawmaker had approached the Court of Appeal, Abuja Division praying it that the judgment against his election be set aside on the grounds that he was not allowed to defend himself in the suit against him and that the originating summon and other court’s processes were allegedly forged and dates on them back-dated to procure the judgment.

The Court of Appeal is expected to give its decision in the matter any moment during the week.

In the same vein, the Chief Judge of the FCT High Court, Justice Is’haq Usman Bello was said to have constituted an administrative panel of enquiry which looked into the grievous allegations made by Senator Ubah against the PDP senatorial candidate- Mr. Obinna Uzoh.
